Returns, Exchange and Refund Policy

This Refund, Return and Exchange Policy applies to purchases made directly through The Fitclub Academy (“TFA”) website. Nothing in this Policy limits any non-waivable rights or remedies available to a customer under applicable consumer-protection laws.

a. Online Digital Courses

TFA offers a refund for an eligible online digital course when the refund request is submitted within seven calendar days of purchase and the course has not been accessed.

A course will be considered accessed when the customer has performed one or more of the following actions:

  1. Opened or viewed course lessons or learning materials;
  2. Streamed or downloaded course content;
  3. Attempted or submitted a quiz, assessment or assignment;
  4. Attended an included online instructional session;
  5. Redeemed or activated a course access code; or
  6. Otherwise substantially commenced use of the course.

Once a digital course has been accessed, it is ordinarily non-refundable, except where a refund or other remedy is required under applicable law.

Where applicable law provides a longer cancellation or withdrawal period, that legally required period will apply. Where permitted by law, customers requesting immediate access to digital content may be required to acknowledge that their cancellation or withdrawal rights may end once access or performance begins.

b. Certification Examinations

Fees paid toward certification examinations, examination registrations, vouchers or access codes are non-refundable once the examination has been registered, scheduled, issued, activated or otherwise made available to the customer.

An examination may be rescheduled subject to the policies, availability, deadlines and applicable charges of TFA or the relevant certification or examination provider.

This provision does not limit any rights available where an examination service has not been provided as described or where a refund or other remedy is required by applicable law.

c. Bundles and Packages

Bundles may contain digital courses, physical products, examination fees, certification vouchers, live training and other services.

A customer may request a refund within seven calendar days of purchase for an eligible digital-course component that has not been accessed. The refundable amount will be calculated according to the separately stated or reasonable value of the eligible, unused component.

The following amounts may be excluded from a bundle refund:

  1. Digital courses that have been accessed;
  2. Certification examinations, vouchers or access codes that have been issued, registered, scheduled, activated or redeemed;
  3. Physical products that are not eligible for return under this Policy;
  4. Live workshops or training that have commenced;
  5. Services that have already been performed; and
  6. Any non-refundable third-party fees, where permitted by law.

Returning one component of a bundle may result in the remaining components being recalculated at their regular individual prices. Any resulting difference may be deducted from the refundable amount, where permitted by law.

d. Physical Products, Including Apparel, Books and Publications

TFA accepts eligible returns and exchanges of physical products within seven calendar days of delivery.

Non-defective products must be returned in new, unused, unwashed and resalable condition, with all original packaging, tags, accessories, books, materials and components included.

A defective, damaged, incorrect, misdescribed or incomplete product may be opened only to the extent reasonably necessary to inspect and identify the problem. TFA may request photographs, videos, packaging images or other reasonable evidence before approving the return.

Products will not be eligible for a voluntary return where they have been used, altered, damaged after delivery, marked, written in, copied, washed, or returned with missing packaging or components. This exclusion does not apply where a remedy is required under applicable law.

Orders Delivered Within India

For an eligible return or exchange delivered within India, TFA will provide return-shipping instructions and, where available, a prepaid return label or pickup service.

TFA will bear reasonable return-shipping costs when the product is defective, damaged during delivery, incorrect, incomplete or materially different from its description.

For an approved non-defective return within the voluntary seven-day return period, TFA may provide a prepaid return method where stated at the time of purchase or return approval.

Orders Delivered Outside India

For international orders, the customer is responsible for arranging and paying for:

  1. Return shipping to TFA;
  2. Shipping associated with an exchange;
  3. Shipping of the replacement product;
  4. Customs duties, import taxes, brokerage fees and clearance charges; and
  5. Any other charges imposed by a carrier, bank, payment provider or government authority.

Original international shipping charges are non-refundable unless the return results from an incorrect, defective, damaged, incomplete or materially misdescribed product, or unless otherwise required by applicable law.

For an international exchange, the customer must pay both the cost of returning the original product and the cost of shipping the replacement product.

TFA does not charge a separate restocking fee. International return shipping, exchange shipping, customs duties and similar charges are shipping or transaction expenses and are not restocking fees.

Customers should use a trackable and adequately insured return-shipping method. Unless otherwise required by law, TFA is not responsible for an international return that is lost or damaged before it is received by TFA.

Inspection and Refund

All physical-product returns are subject to inspection after receipt.

An approved refund will be based on the purchase price of the eligible returned product, less any deductions expressly permitted under this Policy or applicable law.

No deductions will be made from a refund for a defective, damaged, incorrect or materially misdescribed product where such deductions are prohibited by law.

e. Live Workshops, Trainings and Specialty Courses

A refund may be requested before the scheduled training commencement date. Unless otherwise required by applicable law, an administrative and processing charge of ₹2,000 may be deducted from the refund.

No voluntary refund will ordinarily be provided after a live workshop, training or specialty course has commenced or been completed.

Where a training is cancelled by TFA and no suitable replacement date or alternative is accepted by the customer, the affected customer will be eligible for a refund of the amount paid for the cancelled training.

f. How to Request a Refund, Return or Exchange

The customer must contact TFA using the contact information published on the website within the applicable refund or return period.

The request should include:

  1. The customer’s full name;
  2. Order number;
  3. Product, course or service purchased;
  4. Reason for the request; and
  5. Photographs, videos or other supporting evidence where the product is defective, damaged, incorrect or incomplete.

A physical product must not be returned until TFA has provided return authorization and instructions. Unauthorized returns may be delayed or rejected where permitted by law.

g. Refund Method and Charges

Approved refunds will ordinarily be returned to the original payment method.

Where a refund to the original payment method is unavailable, TFA may issue the refund through NEFT, wire transfer or another mutually agreed method.

For voluntary cancellations or returns, actual payment-gateway charges, international bank-transfer charges, currency-conversion charges, customs charges and other non-recoverable transaction expenses may be deducted where disclosed and permitted by law.

Such charges will not be deducted where the refund results from a defective, damaged, incorrect, incomplete or materially misdescribed product or service, or where deduction is prohibited by applicable law.

TFA is not responsible for differences caused by foreign-exchange-rate movements between the purchase and refund dates.

h. Refund Processing Period

TFA will initiate an approved refund within seven working days after:

  1. Approval of the refund request; or
  2. For a physical-product return, receipt and satisfactory inspection of the returned product,

whichever occurs later.

After TFA initiates the refund, the customer’s bank, card issuer or payment provider may require additional time to credit the amount.

i. Mandatory Consumer Rights

The time limits, exclusions and deductions in this Policy apply only to the extent permitted by applicable law.

Customers may have additional rights relating to cancellation, withdrawal, defective products, deficient services, warranties, repairs, replacements or refunds under the laws applicable to their purchase. Those mandatory rights will prevail where they provide greater protection than this Policy.

TFA may approve reasonable exceptions to this Policy on a case-by-case basis. This discretion does not permit TFA to deny or restrict a customer’s mandatory legal rights.
